Art. 3 Conclusion of the Contract

The user will be obliged to pay the price from the moment the online order submission procedure is completed. This will happen by clicking on the "confirm order" button at the end of the guided procedure, which also entails acceptance of the general conditions of sale. The choice of payment by bank transfer will imply that the preparation of the order for shipping takes place only when the seller has verified the correct accounting of the payment.

Once the contract is concluded, the seller takes charge of the order for its fulfillment, which will take place within a maximum of 48 hours, except for public holidays and unexpected closures, also due to regulatory requirements, of the business.
Art. 4 Registered users

The order confirmation must be communicated within a maximum of 48 hours from the time the order is placed. Art. 8 Payment methods and prices

Art. 9 Shipments and delivery

Chiara Cavagna's Cotton Candy ships throughout Italy, excluding the state of Vatican City and the Republic of San Marino. For all international shipments, the user is obliged, before placing the order, to contact the seller directly by email to agree on the possibility, with communication of the amount to be paid by him.

Zucchero Filato di Chiara Cavagna will only make deliveries to the user's home communicated at the time of purchase and this indication will be communicated by the seller to the carrier.

Delivery is generally carried out within 4-5 working days from the order being processed or, if no delivery date is specified, within the maximum deadline estimated at the time of selecting the delivery method and, in any case, within the maximum deadline 30 days from the order confirmation date.

The delivery times indicated in paragraph 3 are intended to relate to an ordinary period of commercial activity and may undergo variations, not dependent on or attributable to Zucchero Filato di Chiara Cavagna, due to national or local regulatory provisions of interruption, suspension, delay or in any case change in regional and/or local sales/transport methods.

Art. 10 Passing of risk

Art. 11 Guarantee and commercial compliance

If the buyer has stipulated the contract as a consumer, or as a natural person who acts on the site for purposes unrelated to any entrepreneurial or professional activity carried out, this guarantee is valid provided that the manufacturing/invoice defect manifests itself within 24 months from the date of delivery of the product, which must be treated with ordinary diligence. Furthermore, it is a condition for accessing the guarantee that the buyer presents a formal complaint to the seller regarding the found defect, to be proven by the buyer, no later than 30 days from the date on which the defect was known by the latter. ; the online complaint form must be correctly completed in its entirety and accompanied by a photographic (or video) representation of the defect.

Art. 12 Withdrawal

In accordance with current legislation, including EU legislation, the buyer has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days from the date of actual delivery, pursuant to art. 57 Legislative Decree 206 of 2005.

In the case of multiple purchases made by the buyer with a single order and delivered separately, the term starts from the date of receipt of the last product.

The goods can be returned by courier or to the point of sale or collection in Italy, as will be indicated on the web page at the time of purchase.

The goods must be returned intact, in the original packaging, complete with the attached tax documentation and tag. The seller has the right to verify the above, in particular with respect to the possible use and/or washing of the clothing or footwear for which the return is requested. The selling party will refund the amount of the products subject to the withdrawal within a maximum of 30 working days, including any shipping costs.

The buyer must scrupulously respect the withdrawal methods communicated by the seller, including the shipping and packaging methods of the goods for which he withdraws.

The right of withdrawal will not apply in the case of sale of services or products referred to in the categories listed in the art. 59 Legislative Decree 206 of 2005.

Zucchero Filato di Chiara Cavagna will provide the refund, having verified the condition of the goods returned to the sender, using the same payment method chosen by the buyer during the purchase phase. In the case of payment made by bank transfer, and if the user intends to exercise his right of withdrawal, he must provide the bank details: IBAN, SWIFT and BIC necessary to make the refund.
The technical times of credit card payment circuits are reserved.
Art. 13 Processing of personal data

Art. 15 Applicable law and competent court

These General Conditions of Sale are governed by Italian law and interpreted on the basis of it, without prejudice to any different mandatory rules prevailing in the country of habitual residence of the buyer. The interpretation, execution or termination of the contract, stipulated in compliance with these General Conditions of Sale, are under the exclusive jurisdiction of Italian law.

Any disputes inherent and/or consequent to the interpretation of the General Conditions of Sale must be addressed exclusively to the Italian jurisdictional authority. If the user has the subjective qualification of Consumer, any disputes must be resolved by the Court of the place of domicile or residence of the same, according to the applicable law. In other cases, the competent court will be that of Rovereto.
